What you agree to when you book an act through MySet, or take a booking as one: how it's made and paid, what happens if plans change, and when the act gets paid.
The host is the person or business booking: for a wedding, a birthday, a company party, a bar or a festival. The act is the artist on MySet being booked. MySet is Idyll Enterprises of Johnson City, Tennessee, USA, which runs myset.vip.
The agreement to perform is between the host and the act. MySet is not the act's employer, manager or agent for finding work, and it doesn't perform or choose which bookings an act takes. It provides the request form, the quotes, the messages and the calendar, and, when a booking is paid through MySet, it collects the payment for the act as the act's limited agent (see Paying).
These booking terms add to MySet's terms of use and privacy notice. Where they say something different about a booking, these booking terms apply.
The request. The host tells the act the date, time, length, kind of event, number of guests and place, and can add songs and a note. A request is a question, not a booking, and either side can walk away from it.
The quote. The act answers with a quote: the price, the deposit, the sets and their length, the line-up, what's included, what the act needs from the host, any travel charge, any optional extras, one of three cancellation policies, and how long it's open (3, 7 or 14 days). Sending a quote is the act's offer to play on exactly those terms. An act agrees to these booking terms the first time it sends a quote, and again with every quote after.
The act can send a new quote before the host accepts; only the newest one can be accepted. A quote closes when it runs out, when the act withdraws it, or when the night is booked by someone else.
Accepting. The host accepts by choosing any extras, typing their name, ticking that they agree to these booking terms, and paying the deposit. The night is booked when the payment goes through, not before. If the payment lands after the quote has closed, all of it goes straight back.
The record. With each booking we keep the name typed, the time, the version of these terms, a fingerprint of the exact quote accepted, and a scrambled (one-way) form of the network address it came from. Both sides can see the booking, its messages and its receipts at any time: the host at their private link, the act in the Studio.
The whole agreement. The accepted quote and these booking terms are the whole agreement for the night. Anything agreed outside them doesn't bind either side unless it's made a change in the booking (see Changes).
One total. The price the host sees on the quote already includes MySet's booking fee. The total shown before accepting is the total the host pays.
The deposit, with its share of the fee, is paid by card when the host accepts. The balance, with the rest of the fee, is charged automatically to the same card 7 days before the night. We remind the host 2 days before we charge it. If the night is less than 7 days away when the host accepts, the whole price is paid at once.
Saving the card. By accepting, the host lets MySet keep the card through Stripe and charge it for the balance of that booking, on the date above. It is never charged for anything else.
A card that's declined. We try again once a day, three times in all, and tell the host each time. The host can pay the balance at their link with another card at any time. If the balance still isn't paid 48 hours before the night, the act may cancel, and that counts as a cancellation by the host under the booking's policy.
Paying MySet is paying the act. The act appoints MySet as its agent to receive payment for its bookings. When the host's payment reaches MySet, the host has paid the act that amount. MySet holds the money on its own Stripe account until it's the act's to receive (see When the act is paid). The charge appears on the host's card statement as MySet.
Where. Payment through MySet is for acts with a US payout account, in US dollars. Receipts for everything paid and refunded are at the host's link and in the act's Studio.
Before a quote is accepted, either side can step away for nothing. Once the night is booked, the host can cancel at their link until the night starts. What comes back depends on the policy the act chose for the quote, counted from the start of the night:
| Policy | If the host cancels |
|---|---|
| Flexible | Full refund until 7 days before, half until 48 hours before, nothing after. |
| Moderate | Full refund until 30 days before, half until 14 days before, nothing after. |
| Strict | Full refund until 60 days before, half until 30 days before, nothing after. |
The host gets back everything they paid, MySet's fee included, as soon as the act cancels. Anything already sent to the act for that booking is taken back from the act's Stripe account. If it can't be, the act owes it to MySet, and MySet may take it from the act's future payouts. An act should cancel only for a serious reason: every cancellation is kept on the act's record, and repeated ones can pause the act's bookings or close its account.
If the night can't happen because of something neither side controls, such as severe weather, a government order, the venue closing, an epidemic, or the serious illness of someone the act can't play without, the side affected should say so in the booking as soon as they know. Moving the date is the first thing to try (see Changes). If no new date works, write to us: MySet decides a fair split of what was paid, and won't keep its own fee on money that goes back.
Either side can ask to change the date, start time, length, number of guests or place, in the booking. Nothing changes until the other side says yes, and both see exactly what changed. If they say no, the booking stays as it was. Before a quote is accepted, the host can also ask for a different price; once the night is booked, the price stays as agreed.
If an agreed change moves the night, the balance date moves with it, still 7 days before. A booking for several dates is several nights: each is played, confirmed and paid on its own.
The act arrives in good time, with what the quote says it brings, and plays the sets, line-up and inclusions quoted. A change to the line-up needs the host's OK in the booking.
The host provides what the quote lists under what the act needs, a safe, covered place to play with the power the act asked for, and, for an outdoor night, cover or a way indoors if the weather turns. The host tells the act any sound limit or curfew before the night; keeping to one is never the act's fault, and time lost to a delay the host causes still counts as played.
Safety. Either side may stop the night for a real threat to anyone's safety, or for harassment. If the act stops for unsafe weather where there was no cover or way indoors, the night counts as played. The host is responsible for their guests, and for alcohol and anyone under age at the event.
Music licences. Playing other people's songs in public needs a performing-rights licence, which is the venue's or the host's to hold. MySet doesn't provide one. A private party in a private home generally doesn't need one.
Recording. Guests may take phone photos and clips for themselves. Recording, streaming or broadcasting the act for anything more needs the act's OK in writing, in the booking.
The day-of details. In the week of the night, the host adds the arrival time and a contact for the day at their link. The act sees the host's phone number only from 48 hours before the night.
Confirming. After the night, the host can confirm it went as booked, which pays the act straight away. If the host does nothing, the night counts as played as booked 72 hours after it ends.
If something went wrong, such as the act arriving very late, playing much less than quoted, a different line-up or not showing, the host reports it at their link within 72 hours of the end of the night, saying what happened. The act's money waits while MySet looks at it. Both sides can tell their side in the booking. MySet decides what's fair, which may be refunding part or all of the price, and tells both sides.
Card disputes. Nothing here takes away the host's rights with their card company. We ask hosts to report a problem to us first, because it's quicker, and to dispute a charge only in good faith. While a bank looks at a dispute, the money for that booking waits. If a night was confirmed, or its 72 hours passed with no problem reported, MySet, not the act, answers for a later dispute, unless the act was at fault or there was fraud.
Reviews. Once a night is played, each side can review the other. Reviews must be honest and about a real booking; nothing in these terms stops anyone leaving an honest review, and nobody may pay for, write or remove a review to make it look better.
Some bookings are made on MySet but paid between the host and the act: when an act can't take payment through MySet yet, or when we've switched payments off. Both sides are told before the host accepts. MySet handles no money for these bookings. The request, quote, messages, changes and calendar work the same, but the payment, any refund and any money kept on cancelling are settled between the host and the act, and the sections on paying, refunds and paying the act don't apply.
What MySet answers for. MySet isn't responsible for how a night goes, or for what a host or an act does, says or fails to do. To the extent the law allows, MySet's total liability to anyone for a booking is limited to the greater of the fees MySet received for that booking, or US$100. The disclaimers and limits in the terms of use apply too.
Disagreements between host and act go first to the booking's messages, then to MySet's problem process above. Disagreements with MySet are handled as the terms of use say, under the laws of Tennessee, USA. If you're a consumer, you keep every protection the law where you live gives you.
Notices and records. We send notices about a booking to its messages, the act's Studio and the email or phone given. You agree to make and keep the booking electronically. Your link or your Studio shows the agreement whenever you want it.
Changes to these terms. We'll give at least 30 days' notice of a change to these booking terms, in the Studio and on this page. A booking stays on the version that was accepted for it.
If part of these terms can't be enforced, the rest still applies. Contact: Idyll Enterprises, Johnson City, Tennessee, USA · hello@myset.vip
